What can I sue for in my predicament?
Me and my friend have bought modded Xbox controllers from Rapidmodz.com and my controller that I paid about $241 for came with broken LEDs, a broken battery holder, and a not-working Jitter Mode. His controller that he paid $210 for came with a malfunctioning mode button, a not-working Jitter Mode, and a not correctly functioning RapidFire Chip. We’ve both bought the warranty and their website says to send it back in for a refund and/or a fixed controller, but we’ve both sent ours in and its been over a month and have still never recieved our paid-for products. Also, we have both tried contacting them with no responses from any of their Live Chat operators, phone calls, sent letters, and sent emails. We want to sue but we dont know what to sue for or how much money or merchandise. So in other words, we’ve been shorted over $400. We still have the receipts of the purchase. What should we do? How did you pay for the purchases?
If it was with a credit card, simply file a dispute with the credit card company. The credit card company will investigate and give you the money back.
You would only be able to sue for your actual damages. Meaning, you could sue for the $241 and your friend could sue for $210. That’s it. You wouldn’t be entitled to anything over and above this.
